VACATION RENTAL TERMS AND CONDITIONS 
(LH North Conway Holdings, LLC - Vacation Rentals – Kearsarge Brook at Cranmore Condominium) 

The following are the terms and conditions of your vacation rental at Kearsarge Brook at Cranmore Condominium (“Condominium”). Guests must comply with these terms, conditions, and Condominium association rules.  

1. RESERVATIONS; CHARGES. Rental rates are subject to a 8.5% room and rental tax. Rates and taxes are subject to change. You must be 21 years of age to rent a unit. Adults may not rent properties on behalf of underage guests. Your signature on the registration card at check-in authorizes LH North Conway Holdings, LLC, to charge your credit card on file for the rental fee as well as any additional charges you may incur due to incidentals or damage, loss, or excessive uncleanliness to the unit during your rental for which you are responsible. LH North Conway Holdings, LLC cannot guarantee specific units in the Condominium or that two reserved units will be adjacent to each other. LH North Conway Holdings, LLC will make commercially reasonable efforts to honor special requests to the best of its abilities.  

2. DEPOSIT.  

  1. For reservations for winter season holiday periods (Christmas week; MLK weekend; Presidents’ Day week), winter season weekends, and summer and fall seasons holiday periods (Memorial Day weekend; July 4th week; Labor Day weekend; Columbus Day weekend):  

  1. A deposit in the amount of one night’s rental, plus tax, is required upon booking.  

  1. The remaining balance of your reservation will be charged to your credit card two days prior to your arrival.  

  1. For reservations for non-holiday, midweek days in the winter season and non-holiday days in the spring, summer and fall seasons:

3. CANCELLATION POLICY. The cancellation policy for all reservations is defined as:  

  1. Cancellations made more than seven days prior to arrival will be allowed with no penalty.  

  1. Cancellations made between seven days and three days prior to arrival will incur a penalty of the deposit amount.  

  1. Cancellations or modifications made within two days of arrival will incur a penalty in the full amount of the stay.  

4. CHECK-IN/CHECK-OUT. Check-in time is 4 p.m. Check-out time is 11:00 a.m. Only the reservation holder may check in and receive keys.  

5. SECURITY/DAMAGE HOLD. LH North Conway Holdings, LLC will place a $500 damage hold on your credit card per Condominium unit reserved when you check-in. After your stay, LH North Conway Holdings, LLC will release the hold once (a) housekeeping verifies that nothing in the Condominium unit is missing or damaged and the unit is not excessively dirty thereby requiring extra cleaning procedures; (b) all keys have been returned; and (c) you have followed the rules and regulations of the Kearsarge Brook Condominiums at Cranmore Unit Owners Association (“Association”). Any repairs, replacement or extra cleaning procedures required as a result of your visit will be paid by deducting funds from the damage hold on your credit card. If repairs for damage to the Condominium, its contents and the facilities and grounds, or extra cleaning charges, exceed the amount of your damage hold, you agree to pay those charges in full and hereby authorize LH North Conway Holdings, LLC to charge those amounts to your credit card on file with LH North Conway Holdings, LLC. Your signature on the registration card provides this authorization. You must inform LH North Conway Holdings, LLC immediately if the unit is dirty or damaged upon check-in. Please report any inoperative equipment or similar problems to the Cranmore Vacation Rentals Office immediately. There are no refunds for appliance, plumbing or mechanical failure, utility failure, or circumstances beyond our control.  

6. PERSONAL PROPERTY DAMAGE AND THEFT. LH North Conway Holdings, LLC and the Association are not responsible for any loss or theft of your personal property or articles you may leave behind in the rental unit. If you leave items behind after check-out, we will take commercially reasonable efforts to ship them to you at your expense.  

7. RENTAL LIMIT. One group may rent a maximum of two Condominium units. Larger social groups must contact LH North Conway Holdings, LLC’s Group Sales Office for lodging options at the resort.  

8. CONDOMINIUM ASSOCIATION RULES AND REGULATIONS. You and your party must comply with all of the Condominium rules and regulations during your stay:  

  1. Occupancy. Each rental unit has a maximum occupancy limit as listed below. These numbers include adults and all children ages 3 and up. Linens are supplied and sufficient to accommodate the maximum capacity of the property. People that are not in your reservation party may not stay overnight in the rental unit. All of your guests visiting you in the rental unit are your sole responsibility. You may not exceed the occupancy limits. The maximum number of reservation guests in a:  

  1. 2-bedroom rental unit is 6;  

  1. 3-bedroom rental unit is 10; and  

  1. 1-bedroom lock-out rental unit is 2.  

  1. No Rental Guests’ Pets/No Smoking. Pets belonging to rental guests’ are not allowed in rental units. If you violate this rule, you may be removed from the Condominium along with your pet, and you will forfeit your damage hold. Smoking of any kind is prohibited inside rental units. If you violate this rule, you will forfeit your damage hold.  

 

  1. Excessive Noise/Parties. You must keep noise to a minimum while arriving, departing, and during your stay in the Condominium. You may not use radios, TVs, stereos, or musical instruments at an excessive volume which annoys occupants of other units. While we want everyone to have a great time staying at the Condominium, wild, rowdy, or drunken partying is not permitted inside the rental unit or on the Condominium grounds. Please be considerate of occupants in other units in the Condominium. If you violate this rule, you will be removed from the rental unit and forfeit your damage hold. Quiet hours are 10pm-9am. 

 

  1. Parking. You must park in designated parking areas only. Parking on the road is not permitted. Any illegally parked cars are subject to towing at the owner’s expense without notice.  

 

  1. Patios/Decks. You are responsible for damage caused by objects falling or thrown from the deck of your rental unit. Hanging towels or any articles of clothing on deck railings or on the patio is strictly prohibited. Use of charcoal, gas or electric grills on the rental unit’s deck or patio is strictly prohibited. The deck or patio furniture are the personal property of the Condominium unit owner and must not be moved to another unit.  

 

  1. Fireworks. Fireworks are strictly prohibited anywhere on the Condominium property.  

 

  1. Fireplace. The fireplace is a non-vented propane gas log fired firebox. Do not throw any paper or other combustible materials in the fireplace.  

 

  1. Trailers. If you are bringing a trailer, please call ahead to the LH North Conway Holdings Vacation Rentals Office to arrange suitable trailer parking. Trailers are not permitted in the Condominium parking area.  

 

  1. Trash. All garbage must be stowed in the dumpster located in the south end of Kearsarge Brook parking lot. Recycling receptacle is located in the first-floor housekeeping closet behind the elevator. Please utilize these receptacles to preserve the beauty of our grounds. Do not leave trash outside the condominium building or the rental unit.  

9. OWNERS’ PETS NOTICE AND DISCLAIMER. By accepting this reservation, you acknowledge and agree that:  

  1. Other unit owners might have their pets with them in their units within the Condominium at the time of your rental.  

 

  1. The owner of the unit you are renting may have had the owner’s pets in the unit prior to your rental. If that is the case, LH North Conway Holdings, LLC will provide you notice of that fact before your occupancy of the unit. You must notify LH North Conway Holdings, LLC immediately upon receiving the pet-occupancy notice if you wish to reserve a pet-free unit. LH North Conway Holdings, LLC will do its best to accommodate your request, subject to pet-free unit availability. If you choose to go forward with your reservation for a unit previously occupied by an owner’s pet, and you or any of your rental party or your visitors to the unit suffer from pet allergies, you are warned to proceed with caution given the pet status of the unit and the Condominium. All units in the LH North Conway Holdings Vacation Rentals program are cleaned before a rental guest’s occupancy.  

10. INDEMNITY. By accepting this reservation, you agree that:  

You and your associated reservation guests expressly assume the risk of any harm arising from your collective use of the rental unit or from others whom you invite into the rental unit; and on behalf of yourself, your associated reservation guests, and your collective successors and assigns, you will indemnify the rental unit owner and LH North Conway Holdings, LLC, their respective employees, agents and representatives, managers and members, and all of their respective successors and assigns (hereinafter referred to as the “Covered Parties”) from and against any and all losses, claims, damages, liabilities, causes of action, cost and expenses including reasonable attorney’s fees for personal injury, property damage or death arising from or in connection with you and your associated reservation guests’ use of the rental unit and access to the Condominium, regardless of any negligence or strict liability on the part of any of the Covered Parties and regardless of the form of claim whether at common law, strict liability, negligence or under any statute or regulation.  

11. VIOLATIONS. If you exceed the rental unit’s maximum occupancy or violate any of the other Association rules and regulations, LH North Conway Holdings, LLC may order you to vacate the unit without a refund. All Association rules are enforced by LH North Conway Holdings, LLC.  

12. TERMS, CONDITIONS AND RULES SUBJECT TO CHANGE. LH North Conway Holdings, LLC may revise these rental terms and conditions, and the Association may revise its rules and regulations at any time. Amended terms, conditions, rules and regulations are binding on reservations guests when furnished to the guest before the guest's occupancy of the rental unit.  

13. LOST KEY CHARGE. Should you fail to return any unit key you will incur a charge of $10.00 per lost key.
